Title 42 remains in place — at least for now.
The U.S. Supreme Court this week temporarily blocked the lifting of the Trump-era rule that provided at least some check on the Biden administration’s failure to secure the U.S. southern border. Put in place in 2020, at the beginning of the pandemic, the rule curtails general asylum for illegal immigrants, quickly expelling them to stop the spread of COVID-19.
Biden has long sought to discontinue the policy, although the administration appears unprepared to handle the mass of migrants pushing over the border.
U.S. Rep. Tom Tiffany (R-WI 7th CD) said the court’s 5-4 decision keeping Title 42 in place while it reviews the policy will at least provide some protections in the months ahead.
Conservative Justice Neil Gorsuch, who broke with his fellow conservatives in writing the dissenting opinion, joined by liberal Justice Justice Ketanji Brown Jackson argued the “current border crisis is not a COVID crisis.”
“And courts should not be in the business of perpetuating administrative edicts designed for one emergency only because elected officials have failed to address a different emergency. We are a court of law, not policymakers of last resort.”
Tiffany agrees.
“It’s good Title 42 is being kept in place, but it’s not the means by which it should be done. It should be done by the Congress of the United States,” Tiffany told Empower Wisconsin’s M.D. Kittle on Wednesday’s Vicki McKenna Show.
The Minocqua Republican said he is joining other House Judiciary Committee members in introducing a bill to secure the border.
“There are two different issues here, there’s secure the border and immigration. This often times gets confused, ‘Well, we’ve got to have comprehensive immigration reforms.’ No, first you secure the border, then you figure out the immigration issue,” he said.
